Terms of service

These terms are an agreement between you (the customer) and [legal entity name] ("UsherStats", "we") for the use of UsherStats. By creating an account you accept them. If you accept on behalf of an organisation, you confirm you may bind it.
1. The service
UsherStats provides web analytics, crawler and AI-bot analytics, journeys, goals and A/B tests, bot protection, proxy mode, a public API and an MCP server, as described in our documentation. We may improve and change the service; we will not remove a core feature from a paid plan during a billing period you have paid for.
2. Accounts
You are responsible for your account, your team members' use of it and the API tokens you create. Keep credentials secret and tell us at once of any unauthorised use.
3. Plans, billing and overage
- Plans, allowances and prices are those on our pricing page when you subscribe. Prices are in US dollars and exclude taxes.
- Paid plans are billed in advance, monthly or yearly, through Stripe, and renew until cancelled. Usage above a plan's allowance is billed in arrears at the overage prices on the pricing page.
- The Free plan is never billed. Above its allowance we notify you, and past 150% of its server requests in a month server-request logging pauses until the month turns.
- You can cancel at any time; the plan runs to the end of the period paid for. [refund policy]
- We will give at least 30 days' notice of a price change, effective from your next renewal.
4. Your data
The data collected from your sites is yours. We process it only to provide the service, under our data processing agreement, which forms part of these terms. You can export it at any time and delete it whenever you wish. You are responsible for having a lawful basis to collect it and for describing UsherStats in your own privacy policy.
5. Acceptable use
You must follow our acceptable use policy. We may suspend a site or an account that breaks it, with notice where we reasonably can.
6. Availability and support
We aim to keep UsherStats available at all times but do not guarantee uninterrupted service. Support is as listed for your plan.
7. Bot protection and proxy mode
Bot protection classifies traffic automatically and can be wrong: it may let an unwanted bot through or challenge a person. You choose its mode and rules for each site, and we recommend starting in log mode. Proxy mode puts UsherStats in the path of requests to your origin; you remain responsible for your origin and its content.
8. Intellectual property
We own UsherStats and its software. You own your content and data. You grant us the rights needed to run the service for you.
9. Liability
To the extent the law allows, the service is provided "as is", and our total liability for any claim in a 12-month period is limited to the fees you paid us in that period. Neither party is liable for indirect or consequential losses. Nothing limits liability that cannot be limited by law. [counsel to finalise]
10. Termination
You may close your account at any time. We may end these terms on 30 days' notice, or at once for a serious breach. On termination you may export your data for [export window, e.g. 30 days], after which it is deleted.
11. Changes
We will notify you by email at least 30 days before a material change to these terms takes effect.
